After the Texas Bar Exam: Performance Reviews

The disappointment associated with failing the Bar exam runs deep for many July 2013 Texas Bar examinees. To address these examinees’ concerns, the Texas Board of Law Examiners (the Board) has provided several ways by which an examinee who was unsuccessful on the Bar exam to review the examinee's performance. These include:

1. Formal Reviews -- Rule XI(g) of the Rules Governing Admission to the Bar of Texas provides for a one-time formal review, which is an individual, oral review of performance on the exam (excluding the MBE). Examinees are entitled to a formal review if they have failed the Bar exam at least twice and have not previously had a formal review. Regardless of the number of exams taken, examinees are entitled to only one formal review. The Board must RECEIVE a written request for a formal review within fourteen (14) days of the date shown on the result letter. This is a receipt deadline, NOT a postmark deadline. Examinees are strongly encouraged to fax their request for a review to 512-463-5300. The review takes place during a regularly scheduled Board meeting. The Board will notify examinees of the exact date and appropriate procedures after the Board receives and processes all requests.

Formal reviews for the July 2012 Texas Bar Examination are tentatively scheduled for January 2013.

2. Informal Reviews –Rule XI(h) of the Rules Governing Admission to the Bar of Texas provides for an informal review of Bar performance on the failed portions of the exam. The examining Board member has the discretion to decide whether this review will be an oral, telephonic, or written review. Examinees are entitled to an informal review each time they fail the Bar exam. The Board must RECEIVE a written request for an informal review within fourteen (14) days of the date shown on the result letter. This is a receipt deadline, NOT a postmark deadline. Examinees are strongly encouraged to fax their request for a review to 512-463-5300. The Board will notify examinees of the appropriate procedures after the Board receives and processes all requests.
